The challenge in this petition is to the order of demolition of a shed, constructed by the petitioner on the terrace of the building, allegedly in breach of the permission of the Planning Authority.

2. Shri Redkar, the learned Counsel for the petitioner states that the petitioner is desirous of filing an application for regularisation as admittedly, no prior permission was obtained from the Panchayat.

3. In that view of the matter, the challenge to the impugned order does not survive. The petition is accordingly disposed of. If the application for regularisation is filed, the competent

WP/816/2018 authority shall decide the same on its own merits and in accordance with law.
