The learned Counsel for the respondent, on instructions, states that the respondent shall withdraw the private criminal complaint filed by the respondent before the learned Judicial Magistrate First Class, Bicholim and an undertaking is already given before the learned Magistrate, Bicholim. The statement is accepted.

3. In view of this, the learned Counsel for the petitioner seeks leave to withdraw the petition.
