2. Shri Joshi, the learned Counsel for the appellant, on instructions, seeks leave to withdraw the appeal, as the appellant is desirous of filing an application for seeking temporary injunction afresh, in the event, the application for amendment is allowed on the basis of change of circumstances.

3. In such circumstances, the appeal is disposed of as withdrawn, with no order as to costs. Needless to mention that if, any such application is filed, the Trial Court shall decide the

AO/35/2018 same on its own merits and in accordance with law. Rival contentions of the parties are left open.
