Heard Mr. H. D. Naik, learned Counsel appearing for the applicant and Ms. Susan Linhares, learned Additional Govt. Advocate for the respondent.

2. This is an application filed by the applicant in the pending petition, inter alia, contending that in the meanwhile, a Demand Notice has been issued to the applicant based on the impugned Notification, without giving any hearing to the applicant. The learned Additional Govt. Advocate, upon instructions from Shri Sandeep B. Dessai, Assistant Director of Transport (Enf) North and Assessing Officer, Goa Rural Improvement and Welfare Cess Act,

CA/166/2016 2000 who is present in the Court, states that the Demand Notice dated 1/8/2016 would be treated as a show cause notice to the applicant and the applicants would be at liberty to file their reply within four weeks from today. After such reply is filed, the concerned Officer shall consider the Demand Notice based on the impugned Notification, on its own merits, in accordance with law.
