Heard the learned counsel for the applicants and the learned Additional Public Prosecutor for the respondents for some time and we do not find that any case for entertaining this application is made out.

2. In such circumstances the learned counsel for the applicants, on instructions, seeks leave to to withdraw the application with liberty to approach the learned Magistrate for discharge.

3. The learned counsel for the applicants also submits that the applicant nos.1 and 3 are already released on bail. However, the

CRMAM/210/2017 applicant no.4 is not yet arrested. The learned counsel for the applicant submits that the applicant no.4 shall approach the learned Sessions Judge seeking anticipatory bail.

4. The learned Additional Public Prosecutor in all fairness submits that as the investigation is complete and the charge sheet is already filed, the investigating agency does not need the presence or custody of the applicant no.4.

5. In such circumstances the application is disposed off as withdrawn. In the event the applicant files an application for discharge, the learned Magistrate shall decide the same in accordance with law.
