Heard the learned counsel for the Petitioner. 2.

We are not inclined to accede to the prayer made by the Petitioner for issue of writ to the Civil Judge to expedite the suit. A litigant can always apply to the Civil Court with a request for expediting the suit and the learned Civil Judge, if the case is so made out, can always consider expediting the suit. The issues sought to be raised by the Petitioner can be raised by the Petitioner in the pending suit if it is so permissible in law. The writ petition is accordingly disposed of.
