The parties have settled the dispute amicably and the consent terms, duly signed by the parties, are filed on record, which are marked 'X' for identification.
2. The dispute is pertaining to an access. Under the terms of the settlement, the petitioner and respondent nos.4 to 7 along with family members, have executed a Sale Deed dated 04/01/2017, in favour of respondent nos.2 and 3, in respect of a strip of land admeasuring 92 square metres, which is a part of Survey Nos.37/4, 37/6 and 37/7 of Dicarpale village.
3. In this view of the matter, respondent nos.2 and 3 have agreed to unconditionally withdraw the suit pending before the
WP/783/2016 Trial Court. The parties have also agreed for setting aside the order passed by the first respondent dated 12/02/2007. In such circumstances, the following order is passed : (i) Leave to delete respondent no.1 is granted. Necessary deletion shall be carried out forthwith.
(ii) The impugned order dated 12/02/2007 passed by the first respondent is set aside, by consent of the parties. (iii) The petition, thus, stands disposed of in view of the consent terms (X), with no order as to costs. C. V. BHADANG, J.
