This is an application to recall the Order passed by this Court dated 03.08.2016 dismissing the Petition for default. Application is supported by an affidavit.

2. Shri Menezes, learned Counsel appearing for the Respondent opposes the application. But, however, records reveal that the learned Counsel was also not present on the day when the matter was dismissed for default.

3. For the reasons stated in the application which stand uncontroverted, the Order dated 03.08.2016 stands recalled. Writ Petition is restored to the file. Place for hearing in the month of
