Heard Mr. Abhay Nachinolkar, learned Counsel appearing for the petitioner and Mr. A. N. S. Nadkarni, learned Advocate General appearing for the respondent no.1,2,3 and 5.

2. After hearing the learned counsel appearing for the parties, it appears that the main grievance of the petitioner is that despite of filing an application under Section 66(5) of Panchayat Raj Act, to assume power conferred therein, respondent no.3 has not proceeded to take such action in accordance with law.

3. Shri Nadkarni, learned Advocate General appearing on behalf of the respondent no. 3 has pointed out that the respondent no.3 shall examine the application filed by the petitioner dated 23.4.2015 and deal with such complainant in accordance with law. The learned Advocate General has also pointed out that such exercise shall be preferably completed within a period of six months.

4. Respondent no. 2 who is present in Court has also accepted that such exercise shall be completed within a period of six months.

5. In view of the above, accepting the said statement by the learned Advocate General, Writ Petition stands disposed of.

6. It is made clear that all the contentions of the parties on merits are left open as we have not examined the merits of the allegations made in the petition.
