The Learned Counsel for the parties do not dispute that the issues in this appeal are the same as the issues raised in the connected First Appeal No. 297/2008. They point out that in this appeal, the contract was for the supply of some additional electronic items but otherwise the facts in this appeal are identical to the connected First Appeal No. 297/2008.

By judgment and decree made today, I have dismissed the First Appeal No. 297/2008. By adopting the very same reasoning, this appeal is also liable to be dismissed. 4.

Accordingly, this appeal is dismissed.

There shall be no order as to costs.
