Heard Mr. Ramaiya, learned counsel for the petitioner. 2.

Mr. Nigel Da Costa Frias, learned counsel for respondent no.8 places on record regularisation order dated 12.10.2022 issued by the Authorised Officer.

Accordingly, Mr. Ramaiya, on instructions from the petitioner, craves leave to withdraw this petition with liberty to challenge the regularisation order in accord with law. Leave is granted as prayed for. 4.

Petition is disposed of as withdrawn with liberty as prayed above. Contentions of all parties are expressly left open. 5.

Further, at the request of Mr Ramaiya, we clarify that if the petitioner initiates appeal against the order dated 12.10.2022 within 2 weeks from today, then the same will be decided on merits without going into the issue of limitation. Mr. Costa Frias, learned counsel for

respondent no.8 states if the appeal is filed within 2 weeks from today, then the issue of limitation will not be raised or pressed. 6.

Miscellaneous Civil Application does not survive disposal of the petition and the same is also disposed of.
