After some arguments, Mr Rodrigues for the petitioner states that in regard to future tenders for electrical works, the representations and suggestions of the 1st petitioner, a registered Society and Association of electrical contractors, may be considered by the Government and, in particular, by the Goa Tourism Development Corporation. The principal submission on behalf of the petitioners is that in these tenders the eligibility criteria should be set in way to attract the maximum number of tenders and competitors to ensure the best possible rates for the Government. At a general level this is, of course, correct. However, this cannot be at the cost of competence and technical ability. Mr Rodrigues agrees, and states that it is not his intention to suggest that persons who are 21st August 2017

905-WP744-17.DOC not qualified or are lacking in the necessary expertise should be allowed to bid. Mr Lawande says that any such representations and suggestions will be given due consideration.

As far as the present tender is concerned, we are not inclined to interfere. The tender was dated 27th June 2017 and the last date for submission of bids was 13th July 2017.

We make it clear that we have not examined the present petition on merits or whether the challenge to the eligibility criteria in this petition has any merit. All contentions are, accordingly, left open except for the present tender.

The petition is disposed of with these observations. There will be no order as to costs.
