Heard Shri S. G. Desai, learned Senior Advocate appearing for the Applicant and Mr. Nitin Sardessai, learned Senior Advocate appearing for the Respondents.

2. This is an application for amendment of the main Petition to incorporate grounds based on subsequent events.

3. Shri Nitin Sardessai, learned Senior Advocate appearing for the Respondents, opposes such request and points out that the averments sought to be made are irrelevant to decide the matter in controversy.

MCA/671/2016 As far as prayer (aa) sought to be incorporated, it is submitted that further steps in that directions have been initiated by the Respondents and a decision would be taken in due course of time.

4. Considering that the application for amendment is to incorporate subsequent events and the averments made therein are referable to the dispute in question, is granted to the Applicants to amend the Petition.

5. However, leave to incorporate para (bb) stands deleted and as far as prayer (aa) is concerned, the statement of the learned Senior Counsel appearing for the Respondent as mentioned in the matter referred to herein above, stands recorded. Amendment to be carried out within two weeks.

6. Respondents, if so advised, to file additional reply within one week thereafter.

7. Application stands disposed of.
