Mr Chauhan says that the proceedings mentioned in prayer clause (a) are pending before the Labour Court and the Respondent-Employer is not co-operating and as such, those proceedings are getting delayed.

Te Presiding Officer is required to expedite the proceedings. While at this stage, we do not accept Mr Chauhan's contention that the Respondent-Employer is delaying the proceedings, if the Labour Court finds that the RespondentEmployer is delaying the proceedings, the Labour Court shall pass appropriate orders so that such proceedings are not unnecessarily delayed.

We clarify that we have not looked into the merits of this matter or otherwise of the pending proceedings before the Labour Court. We clarify that we have not gone into the issue of maintainability. Te Labour Court to decide the proceedings in accordance with law and on its own merits.
