Upon hearing Shri Rohit Bras De Sa, learned Advocate for the petitioner and Shri S. D. Lotlikar,learned Advocate General for the respondent nos. 1 and 2 at length, the only grievance of the petitioner is that despite of the directions issued by this Court vide orders dated 14.7.2016 and 11.8.2016 calling upon the Collector to give a hearing to the petitioner on the application filed by the petitioner before proceeding to take possession in terms of Section 14 of SARFAESI Act, orders have been issued to take possession of the subject premises.

2. Shri S. D. Lotlikar, learned Advocate General states that until directions issued by this Court vide orders dated 14.7.2016 and 11.8.2016 are complied with the orders to take possession shall be kept in abeyance and shall be implemented only after the petitioner

WP/794/2016 is heard as directed by the Court in the said orders. It is also pointed out that the subject orders were issued by the Mamlatdar based on earlier order passed by the Collector.

3. In view of the said statement of the learned Advocate General, the grievances of the petitioner stands presently redressed. The Petition stands accordingly disposed off. All the contentions of the parties are left open.
