3. The application is vehemently objected submitting that grounds have not been made out for condoning the delay.

4. The Respondent has further objected on the ground that the medical reasons assigned for condoning the delay are attributable only to one of the Applicants/Appellants, while others were available to file 13th June, 2025

MCA 495 of 2024 the Appeal.

5. The application is supported by medical records of the Applicant who has filed the application. The application is also supported by an affidavit. These averments are otherwise not seriously controverted by the Respondents.

6. Considering these facts, the delay can be termed as reasonable and sufficiently explained. Consequently, the application is allowed and the delay of 38 days is condoned.

7. The application stands disposed of.
