Heard the learned Additional Public Prosecutor for the applicant-State. This application is filed for cancellation of anticipatory bail granted in favour of the respondent by the learned Sessions Judge vide order dated 20.05.2016 passed in Anticipatory Bail Application No. 122/2016.

2. The learned Sessions Judge has found that prima facie the dispute, is of a civil nature.

3. The brief facts are that the respondent had booked rooms of Hotel Royal Miraj at Candolim, Bardez, Goa, belonging to the complainant, but had failed to pay Rs.5,89,000/- towards the charges, although, the respondent had assured to make the payment. The learned Sessions Judge has found that there were certain invoices raised by the complainant for payment and the payment is not made.

Having heard the learned Additional Public Prosecutor and having gone through the impugned order, I do not find that any exception can be taken to the prima facie finding that the dispute is of a civil nature. Thus, no case for cancellation of anticipatory bail is made out. The criminal application is accordingly rejected. C. V. BHADANG, J.
