1. Heard learned counsel Ms. Pereira for the Applicant and Mr. Nadkarni learned counsel for the the Respondent.

2. Learned Counsel for the Applicant submits that since the Respondent has already appointed the Arbitrator as per their letter dated 27.08.2024 and more specifically, in paragraph no.13, she has instructions to withdraw the present application.

3. Mr. Nadkarni learned counsel appearing for the Respondent would submit that though an application is filed before this Court, the Respondents are objecting to the jurisdiction of this Court for the appointment of Arbitrator, since the venue of the Arbitrator is at 4th September, 2024

AAR 19 of 2024 Cochin as per the Agreement.

4. Such objection is kept open since the Applicant is withdrawing the application in view of the appointment of the Arbitrator vide letter dated 27.08.2024.

5. Accordingly, the application stands disposed of as withdrawn. BHARAT P. DESHPANDE, J.
