1. The parties to this petition had by consent filed an Application for the Appointment of Arbitrator under Section 11 of the Arbitration Act. The Application for Appointment of Arbitrator was registered as Appointment of Arbitrator Application No.8 of 2025 and was disposed of on 24.07.2025, appointing Shri Pradip Sawaikar, a retired District Judge as the sole Arbitrator to decide upon the disputes and differences between the Petitioner and the Respondents arising out of and /or in connection with and/or in relation to Regular Civil Suit No. 180/2022/A disposed by the Court of the CJSD, Margao by the impugned order dated 03.07.2024 in this petition. 25th July, 2025

2. Considering that an Arbitrator is now been appointed to decide the disputes between the parties, which are subject matters of the suit and covered by the Deed of Partnership dated 04.01.2017 between the parties, the challenge to the impugned order dated 03.07.2024, which allows the respondent's application under Section 8 of the Arbitration Act directing the parties to appoint an Arbitrator in view of clause 9 A (iii) of the Partnership Deed.
3. In that view of the matter, the reliefs sought by this petitioner are rendered infructuous. The petition stands disposed of in view of the appointment of the Arbitrator vide order dated 24.07.2025 in Application for Appointment of Arbitrator No. 8 of 2025. VALMIKI MENEZES, J.
