Heard the learned counsel for the applicant and the respondent in person.
2. The Criminal Misc. Application was disposed of by consent on 2/8/2016. However, no orders were passed in so far as the amount lying before this Court is concerned. This application is filed by the applciant for withdrawal of the amount, for which the respondent has no objection. He states that he is not being allowed access to the child. This aspect cannot be gone into in this application. The applicant is at liberty to file appropriate application, if so advised before the learned magistrate. If such an application is filed, the learned Magistrate shall decide the same in accordance with law. In such circumstances, the criminal misc. application no.173/2016 is
CRMA/173/2016 allowed, as prayed. The amount of Rs.38,000/- lying before this Court shall be paid to the applicant/wife along with interest, if any. The application is disposed of in the aforesaid terms. C. V. BHADANG, J.
