The petitioner is the defendant no.7, who is seeking a relief for expediting the proceeding in Special Civil Suit no.10/2014/A on the file of the learned Senior Civil Judge at Ponda. Admittedly, the application for temporary injunction filed by the respondent/plaintiff is pending in which there is no ad interim relief operating against the petitioner. It is thus difficult to understand how the petitioner can be aggrieved in the matter. The learned counsel for the petitioner submits that the petitioner has raised a counter claim in the suit and an application for temporary injunction is filed on 5/9/2017. It is for the petitioner to seek appropriate relief from the trial court. At this stage no case for such direction is made out. The petition is accordingly
