Heard the learned Counsel for the Applicant.

The Respondent is duly served and the affidavit of service is placed on record, which is dated 27.08.2024 along with a copy of the email.

This is an Application for extension of the mandate of the Arbitral Tribunal for a period of nine months. 4.

Vide order dated 14.07.2021 passed in Application for Appointment of Arbitrator No. 863 of 2024 (F), this Court 4th September 2024

29 MCA 404 OF 2024.ODT appointed the Arbitral Tribunal and directed the parties to appear before the said Tribunal. Thereafter, vide order dated 26.07.2023 passed in Miscellaneous Civil Application No. 261 of 2023, the mandate of the Arbitral Tribunal was extended by a period of one year.

The learned Counsel for the Applicant submits that the said extended period is about to complete, however, the matter is kept for final hearing.

Accordingly and for the reasons disclosed in the present Application, the same stands allowed as per prayer clause (a), which reads thus:

(a) That this Hon'ble Court may be pleased to extend the mandate of the Arbitral Tribunal comprising the ld. Sole Arbitrator, the Hon'ble Mr. Justice R.M.S. Khandeparker (Retd.) for a period of nine months or for such further period of time, as this Hon'ble Court deems fit and proper.
