He submits that the appellant is expired i.e. Thomas Nicefero Rodrigues on 09.07.2015. His Legal Representatives have filed this application on 09.09.2015 to bring LR's of deceased appellant i.e. Thomas Nicefero Rodrigues on record.

Perused the application. It is supported by an affidavit of appellant no.8 Mr. Peter Frank Rodrigues. Applicants have also produced a true copy of death certificate. The application is filed within limitation. The copy of this application is also served upon respondents on 09.09.2015. Thereafter, the matter came on the Registrar's board on 29.10.2015 and 21.01.2016. However, none appeared on these dates. So, the application is uncontested. As the application is within limitation, it is allowed and accordingly disposed of vide Chapter II rule 3(I) of the Bombay High Court Appellate Side Rules, 1960. Appellant to carry out the necessary
