This is an application for restoration of the petition which was dismissed on 11/08/2017.

2. Shri Bandodkar, learned Advocate for the applicants submitted that when the matter was called out on 11/08/2017 he was on his legs before the Civil Court at Panaji and in the meanwhile the matter came to be called out and was dismissed for default. He was under the bodafide belief that the matter which was at Serial no.78 would not be called out on the said date. He learnt of the dismissal on 16/08/2017 and moved his application with expedition.

3. The grounds urged in the application appear to be reasonable and therefore in the circumstances the application is allowed and the petition restored to file. The application stands disposed off accordingly.
