Heard Mr. Rivankar, learned counsel for the applicant.

2. Delay of 11 days occurred in filing an appeal against the order of acquittal of the respondent by the learned JMFC in Criminal Case No.42/S/2015 on 4.5.2017 for which the reason assigned by the learned Public Prosecutor is that it took some time to forward file from the Chief Secretary to the Home Department and for seeking approval of the Government.

3. The learned counsel appearing for the respondent took objection to the reasons stated in the application.

4. However, considering the reasons stated hereinabove, it

CRMA/289/2017 would be just and proper to condone the delay. As such, the delay is condoned.

5. Let the appeal be registered.

6. Application stands disposed of.
