Shri Coutinho, the learned counsel for the petitioners, on instructions, seeks leave to withdraw the petition, as the petitioner intends to take recourse to the provisions of Order 13 Rule 1 (3) of C.P.C. for using the document namely, the plaint in (Old) Civil Suit no. RCS No.281/75 which is RCS No.14/1988 (New) for the purpose of cross examination of the defendant's witness. The petition is accordingly disposed off as withdrawn with liberty as prayed.
