Leave to delete respondent no.2 is already granted.

2. The learned Counsel for the petitioner submits that he also wants to delete name of respondent nos.3 and 4 as they are not concerned with the controversy involved in the petition. Leave is granted to delete the respondent nos.3 and 4 at the risk of the petitioner.

3. By order dated 20.9.2017, the learned Counsel for the petitioner, on instructions, submitted that petitioner was ready to pay Rs.4000/-per month to the respondent/wife. He was, inter alia directed to clear the arrears of maintenance within a period of three weeks from 20.9.2017. However, the petitioner did not comply with the said directions in the order dated 20.9.2017. Petitioner was granted sufficient opportunities, however, he has

CRIR/42/2017 not paid single pie to the respondent/wife. The talks of settlement between the parties could not be materialised. Petitioner was granted last chance to deposit 50% of the arrears within a period of two weeks. However, the petitioner failed to comply with that directions also and thereafter two more opportunities were granted on 29.11.2017 and 18.12.2017. Learned Counsel for the petitioner, on instructions, submits that petitioner has no means to comply with the directions of this Court. That being so, petition needs to be dismissed, and, therefore, it stands dismissed.
