The learned Counsel for the Petitioner, on instructions, from the Petitioner who is personally present before the Court, restricts his submission to prayer clause (a) by which a direction is sought to the second Respondent-Bank to issue No Due Certificate and to endorse Form no. 35 from the Director of Transport cancelling the mortgage in respect of the vehicle bearing no. GA-01-R-4260 in the name of the Petitioner. The rest of the prayers are not pressed.

2. The learned Counsel appearing for the second Respondent, on instructions, states that if the Petitioner approaches the Bank with Form no. 35, the Bank will issue the Form no. 35 as also a No Due Certificate. The statement on behalf of the second Respondent is accepted.

3. In such circumstances, the Petition is disposed of in the following terms.

The Petitioner shall approach the second Respondent-Bank with a Form no. 35 duly filled in tomorrow i.e. 03.05.2016 and the Respondent shall issue the Form no. 35 and No Dues Certificate within a period of two working days thereafter.

4. It is made clear that this Court has not expressed any opinion of the other reliefs sought in the Petition, which are not pressed by the Petitioner.
