This is an application for condonation of delay in filing an application for setting aside abatement and for bringing the legal representatives of the deceased appellant No.2 on record.

2. Heard the learned counsel for the applicant and the respondent No.1. It appears that the appellant No.2 Gorgibai Pandurang Naik Dessai since deceased is survived by her husband, a son and daughter-in-law, who are the proposed appellants No.2A and 2B. It appears that the appellant No.1, who is the husband of the deceased is already on record. As such, the estate being sufficiently represented there would not be any abatement.

3. On hearing the learned counsel for the applicant and the first respondent, the prayer for bringing the proposed legal representatives on record, is allowed. Amendment to be carried out within one week.
