Heard Mr. S. Desai, leaned Counsel appearing for the petitioners.

2. Mr. Desai, learned Counsel submits that the proposed amendment was just clarificatory in nature in support of which documentary evidence has already been tendered.

3. After hearing the learned Counsel for sometime, I find that no case is made out for interference in the impugned order dated 3.8.2017. At this stage, Shri S. Desai, learned Counsel seeks leave to withdraw the petition with liberty to raise the said issue of amendment of pleadings in appeal, in case the suit is dismissed,the said issue may be kept open.
