Heard Mr. Nigel Da Costa Frias, learned Counsel appearing for Applicant. Respondent though served, remained absent.

2. During the course of arguments, learned Counsel appearing for the Applicant pointed out that there is a dispute between the Applicant and the Respondent in reference to their agricultural tenancy. The issue was referred to the learned Mamlatdar. The Mamlatdar informed that Respondent no. 2 is not a tenant and decided the issue in the negative. Inspite of that fact, the learned Adhoc District Judge has ordered to pay half of the compensation to the Respondent which, according to Mr. Nigel Da Costa Frias, learned Counsel appearing for the Applicant, is contrary to the

CA/90/2015 findings given by the learned Mamlatdar.

3. In view of the above submissions, there shall be interim relief in terms of prayer clause (a) till the disposal of the Appeal.

4. Civil Application stands disposed of.
