Heard Mr. Noor Mohamad, petitioner, in person. He has a grievance against the Department of Post, where he is presently employed as a Postal Assistant. His grievance is regarding denial of promotion as well as fixation of pay, which according to him is wrongly denied to him.

Worth it to note that, considering that his remedy lies before the Central Administrative Tribunal, he had filed some proceedings before the Tribunal for redressal of his grievance, which he has

placed before us and from the affidavit filed by the respondent, we find that the order dated 29/11/2024 passed by the Central Administrative Tribunal in its order sheet recording that if the objections are not removed, the original application shall be dismissed without reference to the Tribunal, is indicative of the fact that the petitioner has in fact approached the Central Administrative Tribunal.

Today, Mr. Noor Mohammad has filed a rejoinder before us, where he has placed certain withdrawal praecipes, which according to him, he has moved it before the Tribunal and he has placed certain correspondence in the form of screenshots, which is probably received by him on his mobile number and from the screenshots, we cannot clearly conclude whether the proceedings before the Tribunal have been disposed of or are still pending. In any case, if the remedy available to the petitioner is proceeding before the Tribunal, it is for him to sort out the things before the Tribunal, and if the original application filed by him is disposed of on account of non-removal of office objections, he has remedy to take appropriate steps.

Leaving the liberty open to pursue his remedy before the Central Administrative Tribunal, Mumbai, for the grievance which he has raised in the petition, we dispose of the petition in the wake of an effective alternative remedy being applicable. Petition stands dismissed.
