1. Registry to waive office objections and register the matter.
2. This is a compounding application seeking compounding of
offence under Section 138 of the NI Act, of which the Applicant is convicted by an order dated 30.11.2022 passed by the JMFC, Ponda in Criminal Case No.121/OA/NIA/2020/B. The appeal against the order was also dismissed on 31.08.2024 by the Sessions Court in Criminal Appeal No.257/2023, against which the present revision application was filed.
3. The Applicant has directly deposited before the Respondent No.1-Cooperative Bank an amount of Rs. 50,000/-, which was acknowledged by a No Due Certificate dated 15.02.2025 issued by the said Co-operative Bank to the Applicant, which is placed on record.
4. The applicant has also deposited the penalty amount of Rs.2,760/- with the Goa State Legal Services Authority on 22.09.2025.
5. Shri Anant Pandurang Naik, Branch Manager of Respondent No.1 is present today and records that the Respondent No.1 has no objection to compound the offence.
6. Accordingly, the applicant stands acquitted of the offence under Section 138 of the NI Act for which he was convicted by the order dated 30.11.2022 in Criminal Case No.121/OA/NIA/2020/B.
7. With this Application, CRIR No.38 of 2025 and CRMA No. 739 of 2025(F) also stand disposed of.
