The learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to raise the contention about the territorial jurisdiction of the Court in the written statement. The petition is accordingly disposed as withdrawn with liberty as prayed. If the contention about the territorial jurisdiction of the trial court is raised in the written statement, it is obvious that the trial court shall frame appropriate issue and the same shall be gone into at the trial of the suit, without being influenced by the observations made in the impugned order.
