Heard Mr. A. Nachinolkar, learned Counsel appearing for the applicant and Mr. S. Redkar, learned Counsel appearing for the respondents No.1, 2 and 5.

2. This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996. The fact that there is an arbitration clause in the partnership deed which covers the dispute sought to be raised by the applicant is not disputed. The respondents also do not dispute that the applicant is entitled to get the dispute resolved by arbitration. Both the learned Counsel suggest that Mr. J.P. Mulgaonkar, Advocate having office at Panaji, Goa be appointed as the sole Arbitrator to adjudicate the dispute between the parties.

3. Hence, the following order is passed : (i) Mr. J.P. Mulgaonkar, Advocate is appointed as the sole arbitrator to adjudicate the dispute between the parties. (ii) All contentions of both the parties are left open. The application stands disposed of accordingly. F. M. REIS, J.
