Having heard the learned Counsel for the parties, the Misc. Civil Application 713/2016 seeking amendment of the petition is hereby allowed.

2. However, it is clarified that merely because the amendment is allowed, that ought not to be construed as acceptance of any of the pleadings now being introduced by way of amendment. Whether

such pleadings should be accepted or not and further what is the effect of such pleadings is something which the respondents will undoubtedly be entitled to urge and argue at the stage of final hearing.

3. The amendment to be carried out forthwith.

4. The copy of the amended petition to be served on the learned Counsel for the respondents and the respondents are also granted liberty to file reply to the amended petition.

5. Mr. Sardessai, learned Counsel states that such reply will be filed within the course of one week from today to the amended petition.

6. The Misc. Civil Application 713/2016 is disposed of on the aforesaid terms.
