Heard Shri Sudesh M. Usgaonkar, learned Counsel appearing for the petitioners, Shri Vivek Rodrigues, learned Additional Govt. Advocate appearing for the respondents No.1 and 2 and Shri Ryan Menezes, learned Counsel appearing for respondent No.3.

2. The above petition takes exception to the order dated 29th June, 2014, issued by the local Panchayat Respondent No.3, whereby the application submitted by the petitioners, along with the technical clearance order dated 3/4/2014 was ordered to be kept pending, in view of a joint inspection intended to be carried out by the Town and Country Planning Department, respondent No.2 herein. It was brought to our notice by Shri Rodrigues, learned Counsel appearing for respondent No.2 that such an inspection has already been carried

WP/713/2014 out and the report has already been submitted to the local Panchayat respondent No.3 and the said report is placed on record at page 44 of the petition.

3. Shri Ryan Menezes, learned Counsel appearing for respondent No.3 local Village Panchayat, upon instructions, points out that respondent No.3 shall proceed to consider the said application dated 29/5/2014 submitted by the petitioners and take final decision thereon with a period of six weeks from today.

4. Considering the statement of Shri Ryan Menezes, learned Counsel appearing for respondent No.3, which is accepted, we find that the grievances of the petitioners are redressed at this stage.

5. Hence, the petition stands disposed of on the basis of the said statement of the learned Counsel appearing for the respondent No.3 and, as such, the respondent No.3 shall take the final decision on the said application dated 29/5/2014 filed by the petitioners, within a period of six weeks from today, in accordance with law.
