Since the Petitioner's brother has already filed an appeal before the NGT which is pending in respect of the subject property, it is open for the Petitioner to either apply for impleading himself as a party in the appeal or with leave of the NGT, file an appeal. We are therefore not inclined to entertain this petition.

2. All contentions are kept open. It is made clear that we have not gone into any of the contentions on merits.

3. Petition is disposed of.
