The above petition inter-alia seeks to challenge the order dated 15.09.2008 passed by the Commissioner for persons with disabilities inter-alia directing to hold a fresh D.P.C.

It is pointed out by Mr. D. Pangam, learned counsel appearing for the petitioner that the original complainant who was promoted before filing the above Writ Petition has already retired. Mr. Pangam, learned counsel further pointed out that the petitioner has already been promoted and as such the question of holding any fresh D.P.C. in view of promotion and retirement of respondent no.3 would not arise. In such

:3: W P NO. 611 of 2008 circumstances, the petition stands dismissed as infructuous and consequently, the impugned order dated 15.09.2008 would not have any legal effect. Rule stands disposed of accordingly with no order as to costs.
