Anchor Electricals Private Limited Through Its Manager Shri. Chandrashekhar Kanse. v. Cenzer Industries Limited.
IN THE HIGH COURT OF BOMBAY AT GOA
COMPANY PETITION NO. 2 OF 2015 ANCHOR ELECTRICALS PRIVATE LIMITED THROUGH ITS MANAGER SHRI.
CHANDRASHEKHAR KANSE.
... Petitioner
Versus
CENZER INDUSTRIES LIMITED.
... Respondent Mr. P. Karpe, Advocate for the petitioner.
Mr. Abhay Nachinolkar, Advocate for the respondent. Coram:- F. M. REIS, J.
Date:- 4th March, 2016 P.C.:
Heard Mr. P. Karpe, learned Counsel appearing for the petitioner and Mr. A. Nachinolkar, learned Counsel appearing for the respondent.
2. Mr. P. Karpe, learned Counsel appearing for the petitioner, upon instructions from the petitioner, points out that the statutory notice issued to the respondent is defective as it was not addressed to the Registered Office of the respondent. This contention itself would suggest that the winding up petition is not maintainable and, as such, deserves to be rejected. Needless to say, the petitioner, if so advised, may pursue their claim in accordance with law.
3. The petition stands disposed of accordingly. F. M. REIS, J.
