None present for the appellants. Mr. Ramani, learned Counsel is present on behalf of the respondent no. 7.

2. It is seen that respondent no. 8 had died on 18.12.2007 i.e. after passing the award by the Reference Court. However, no steps are taken for bringing the legal representatives of deceased respondent no. 8 on record, due to which the appeal has abated. Even by previous order dated 17.03.2009, the appeal has been held to have abated as against several respondents and appeal has been dismissed against some respondents.

3. In view of the above, the appeal stands dismissed for default and non-prosecution.
