Mr. S.R. Rivankar, the learned Public Prosecutor for the applicant states that respondent no. 7 was already discharged and there is no challenge to such discharge in the accompanying Appeal against acquittal. He pointed out that respondent no. 6 is absconding and was also not served during the course of trial before the Sessions Court.

2. The report of the Registry shows that respondent nos. 2 to 5 have been duly served.

3. Taking into consideration the averments made, three days delay in instituting the appeal is hereby condoned. Registry to

CRMA/23/2020 now number the application seeking leave to appeal against acquittal and place the same on 23.03.2020.
