Heard Mr. Kakodkar, learned counsel for the petitioner and learned counsel for the respondent no.1.

Considering the fact that an application for regularization of the structure directed to be demolished by the order passed on 23/11/2009, has been made and it is pending for consideration of the concerned authority including the Town and Country Planning department with whom at present the application is lying, the purpose of this petition would be served if the order of demolition dated 23/11/2009 is kept in abeyance, till the application for regularization is decided finally and in case the application is rejected, it shall be continued to be in abeyance for a further period of 30 days from the date of communication of the order of rejection to the petitioner. The regularization application shall be finally decided within a period of 3

WP/21/2015 months from the date of the order. It is ordered accordingly and the petition is disposed of in the above terms.
