The Respondent No.1 states that he is ready and willing to pay the total amount of Rs.7,00,000/- within a period of five months towards one-time settlement regarding all the dues payable by him to the Appellant bank. The Manager Recovery of the Appellant bank states that the Appellants are ready and willing to accept the said proposal by the Respondent No.1. Both the parties state that the matter may be considered as settled accordingly. We accept the statement made on behalf of both the parties and record that the Respondents shall pay the entire amount of Rs.7,00,000/- as one-time settlement and all the dues payable to the Appellant within five months from today.

In case of failure to pay the said amount as agreed upon, the entire amount shall become due and payable by the Respondents in terms of the original agreement and the Appellant shall be entitled to start the recovery proceedings in that regard. We accept the above statement and dispose of the matter accordingly. SHRI JUSTICE R. M. S.
