Heard Mr Amay Phadte for the petitioner and Mr P.A. Kamat for the respondent.

Mr P.A. Kamat places on record a site inspection report on behalf of the Panchayat in which it is stated that compound wall constructed by the petitioner on the existing access is removed. The site inspection report states that present 2.80 metres access is available on the site. The photocopies of such access are also placed on record. The site inspection report is taken on record in this matter. 8th March 2023

Mr Phadte, based on instructions from the petitioner including Mr Wilfred Lopes, who is present in the Court, states that no further construction would be carried out on this access. 4.

Mr. Phadte, based on instructions, states that no further construction would be carried out on the access. He states that if any such construction is undertaken, then, the Panchayat will have the liberty to demolish the same without requirement of issuing any further notices to the petitioner.

This statement is accepted.

Based upon the above, the learned Counsel for the parties, request that this petition should be disposed of. Accordingly, this petition is disposed of.
