After judgment was pronounced in open Court in the other matters, including the Suo Motu PIL, Mr Ivo Cardoso appears in person and says that he has a MCA in SMWP No 1 of 2017. We find that the MCA is still under objections. It was filed on 12th September 2017 but he has not cared to remove the objections. Nonetheless, we have allowed him to proceed. He now says that he represents "a larger public interest" and "larger community" but of 11th October 2017

903-MCA853-17.doc this in his application on merits we find no evidence. There is therefore nothing to indicate that this is a representative cause. We will, nonetheless, allow him even further indulgence. All he has to say is that Delhi is more convenient until a Circuit Bench of NGT is established. He insists Pune is inconvenient. All this is already argued and we have considered it comprehensively in the main judgment. We do not believe that it is appropriate at this stage to reopen that debate. We most certainly will not permit the applicant to further delay the matter and that too on grounds that have been already considered. We may only note that his statement that it takes three days to go Pune is demonstrably incorrect. The second submission, that there are cases in Pune filed by busibodies and NGOs needs only to be stated to be rejected. The genuineness of a petitioner is not determined by distance he has to travel. 2.

This application is dismissed.

For the record we will note the intervention is yet on a Stamp Number but we direct the registry to have it numbered. All objections are dispensed with.
