The petitioner has been convicted of the offence punishable under Section 138 of the Negotiable Instruments Act by JMFC Panaji and sentenced him to undergo S.I.for six months alongwith compensation of Rs.3,76,320/-. Criminal Appeal No.194/2015 preferred by the petitioner before the learned Additional Sessions Judge has been dismissed on 5th September, 2017.

2. It is submitted that during pendency of the appeal, the petitioner was enlarged on bail by suspending the sentence. It is submitted that the petitioner has deposited Rs.50,000/- in the Sessions Court.

3. Considering the aforesaid facts, it would be just and proper to suspend the sentence pending the Criminal Revision Application preferred by the petitioner on his furnishing fresh surety in the sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the Registrar (Judicial) of this Court and also subject to deposit of Rs.50,000/- by the petitioner in the Sessions Court within a week.

4. Application stands disposed of accordingly.
