Heard Ms A. Fernandes for the Petitioner and Mr S. Parab who holds for Mr. Shubham Priolkar, learned Additional Government Advocate, for the Respondents.

The Petitioner contends that he is entitled to benefits of the Career Advancement Scheme by granting Selection Grade and Senior Scale with retrospective effect. The Petitioner has pointed out to some anomalies while granting the appropriate pay scales to him. 3.

The Petitioner's grievance is contended in his representation dated 19.04.2018 which was forwarded to the Directorate of Higher Education 31st January 2023

11 WP-436-2022.doc on 19.04.2018. The Petitioner complains that till date his representation has not been considered.

Accordingly, we direct the Director of Higher Education or any of the concerned Respondents to dispose of the Petitioner's representation at Annexure J colly (pages 40 and 41 of the petition) as expeditiously as possible and in any case within two months from today. The Director should consider granting the Petitioner a personal hearing in the peculiar facts of the present case so that the Petitioner can explain his case in an appropriate manner. The Director should communicate his decision to the Petitioner within this period of two months. 5.

If the Petitioner is aggrieved by this, then, the Petitioner will have the liberty to challenge the same including by way of raising all the grounds and challenging all the orders that were originally impugned in this petition. All contentions of all parties in this regard are expressly kept open.

The petition is disposed of with the above directions. There shall be no order for costs.
