Diogo Venancio Pinto, Thr. His Poa, Richard Dionisio Pinto., v. State Of Goa, Thr. The Chief Secretary And 6 ORS.,
Santosh 1 wp836-17dt30-10-17 IN THE HIGH COURT OF BOMBAY AT GOA WRIT PETITION NO.836 OF 2017 Diogo Venancio Pioto, through his POA.
......
Petitioner.
Versus
The State of Goa, through the Chief Secretary & Ors.
...... Respondents.
Mr. Vithal S. Naik, Advocate for the Petitioner. Mr. Sagar Dhargalkar, Additional Govt. Advocate for Respondent No.1.
Coram : N.M. Jamdar & Prithviraj K. Chavan, JJ.
Date : 30 October 2017.
P.C.:
This Writ Petition is filed by the Petitioner seeking expeditious disposal of his four Civil Suits pending in the Civil Courts.
2.
This Court, on 20 September 2017, permitted the Petitioner to approach the learned Civil Judge for fixing an early date of hearing in his various litigations. The learned Counsel for the Petitioner states that the Petitioner has already so applied and one such proceedings have been expedited and on the other applications
Santosh 2 wp836-17dt30-10-17 no decision has yet been taken.
3.
If the Petitioner's cause is as serious as sought to be contended, then we have no doubt that the same will be looked into by the learned Civil Court and appropriate orders will be passed after due regard to pendency of cases before it. Further more, no such directions can be issued to a Civil Court under Article 226 of the Constitution of India. Be that as it may, since the learned Civil Judge is already looking into the prayer of the Petitioner, we do not find it necessary to keep the Writ Petition pending on the file which is, accordingly, disposed of.
