There is a delay of 45 days in filing the Appeal. In paragraph 3, the Applicant states that he has undergone heart surgery and his movements were restricted. He has to rely upon his daughter who is presently resident in Mumbai, to come down to Goa and assist him in this matter. The Applicant himself was also unable to travel to Goa from Mumbai where he was recuperating. The delay is not such as cannot be condoned. The reasons are sufficient. 2.
The Civil Application is made absolute in terms of prayer clause (a).
